1. Who you're contracting with
Tommage ("the service") is operated by Sloan Contracting ("we", "us"). By creating an account or otherwise using the service you agree to these Terms.2. The service
Tommage is a community map for discovering and listing garage sales. You can browse sales, post your own, save favourites, and leave reviews. We don't sell or warehouse any of the items listed by hosts.
3. Acceptable use
You must not misuse the service. In particular, you must not: use it unlawfully, post fraudulent or misleading listings, infringe anyone's intellectual property, harass other users, attempt to gain unauthorised access, scrape the site, or interfere with its security or availability.
4. Your account
You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. You must be of legal age in your jurisdiction.
5. Your content
You retain ownership of the listings, photos and reviews you post. You grant us a worldwide, non-exclusive, royalty-free licence to host, display and distribute your content solely to operate and promote the service. You're responsible for the legality of what you post and for honouring any listings you advertise.
6. Our IP
The Tommage name, branding, software, and design are owned by Sloan Contracting. We grant you a limited, non-exclusive, non-transferable right to use the service for its intended purpose. No reverse engineering, resale or circumvention of technical limits.
7. Payments and add-ons
Posting a basic listing is free. Optional paid add-ons are described on our Pricing page. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing, taxes, cancellations and refunds are governed by Paddle's Buyer Terms and our Refund Policy.8. Service level
We work hard to keep Tommage available, but we don't guarantee uninterrupted or error-free operation. Features may change as the product evolves.
9. Suspension or termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated/serious policy violations. You can close your account at any time.
10. Warranties and liability
To the fullest extent permitted by law, the service is provided "as is" and we disclaim all implied warranties (including merchantability and fitness for a particular purpose). Our aggregate liability arising out of or relating to the service is capped at the fees you paid us in the 12 months before the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law (such as for fraud, death or personal injury caused by negligence).
11. Indemnity
You agree to indemnify Sloan Contracting against third-party claims arising from your content, unlawful use of the service, or breach of these Terms.
12. Governing law
These Terms are governed by the laws of Australia. Disputes are subject to the exclusive jurisdiction of Australian courts, unless mandatory consumer law gives you a different right.
13. Changes
We may update these Terms from time to time. Continued use of the service after changes take effect means you accept the updated Terms.
